Welcome to OptimaVida Health & Wellness LLC.
By accessing this website and using our services, you agree to the following Terms of Service.
1. Scope of Services
Patients voluntarily engage in telehealth consultations with OptimaVida Health & Wellness LLC providers, including, but not limited to, Autonomous Advanced Practice Registered Nurses practicing within applicable state laws.
Services may include, but are not limited to:
• Primary care
• Health promotion
• Chronic disease management
• Lifestyle counseling
• Hormone optimization and replacement therapy
• Medical weight loss programs
Membership includes, but is not limited to:
• Telehealth visits
• Messaging access
• Personalized diet and exercise planning
• Evaluation visits as outlined in the selected plan
2. Appointments & Cancellations
Standard visit time for membership visits or single evaluation visits is 30 minutes, or as determined by the provider. Payment is required at booking.
• Cancellations or rescheduling requests must be received at least 48 hours in advance or the full visit fee will be charged.
• If you arrive late, your visit time may be shortened.
• Cards on file will be charged 24 hours prior to your appointment if payment has not been received.
OptimaVida Health & Wellness LLC is not liable for missed care, delays, or outcomes resulting from missed, delayed, shortened, or canceled appointments.
3. Telephone & Portal Communication
Between visits, patients may contact OptimaVida Health & Wellness LLC through the patient portal or by phone.
• Messages are typically returned within 24 hours.
• Telehealth services require live video visits.
Electronic communication includes, but is not limited to: text messaging, email, phone, and internet-based platforms. These methods are not guaranteed to be secure, and OptimaVida Health & Wellness LLC is not liable for unauthorized access, delays, or breaches beyond its reasonable control.
4. Electronic Communication & Telehealth Acknowledgment
You voluntarily choose to participate in telehealth services. You understand that you will provide valid identification, current location, medical history, current concerns, and treatment goals via questionnaires, messaging, images (if needed), and/or live video.
You acknowledge:
• Telehealth visits differ from in-person visits.
• A hands-on physical exam may be limited or not performed.
• Medical decisions are based on the information you provide.
OptimaVida Health & Wellness LLC is not liable for conditions missed, delayed diagnoses, or outcomes resulting from telehealth limitations.
5. No Emergency Services
Telehealth services are not emergency services. If you experience a medical emergency, you must call 911 or go to the nearest emergency department.
OptimaVida Health & Wellness LLC is not liable for any adverse outcomes resulting from failure to seek emergency care.
6. Third-Party Services
We use third-party platforms including, but not limited to: CharmHealth, Spruce Health, Stripe, Doximity, Rupa Health, Quest Diagnostics, and Labcorp.
OptimaVida Health & Wellness LLC is not liable for errors, outages, delays, data breaches, or failures of third-party services.
7. Labs, Imaging & Additional Fees
Labs, imaging, prescriptions, and outside services are not included in membership fees. Patients are responsible for all services including, but not limited to: laboratory testing, imaging, hospital care, urgent care, specialty care, and pharmacy services.
• If discounted labs are offered, patients will be invoiced directly.
• Labs are non-refundable once ordered.
• A lab interpretation fee may apply.
OptimaVida Health & Wellness LLC is not liable for outcomes related to third-party services.
8. Insurance & Government Programs
OptimaVida Health & Wellness LLC does not participate in: Insurance plans, HMOs, Medicare, Medicaid, or Government healthcare programs.
This agreement:
• Is not insurance and does not replace insurance.
• Does not cover hospitalizations, catastrophic events, or specialty services.
• Does not qualify as minimum essential coverage.
• Is not workers’ compensation and is not an HMO.
Patients are strongly encouraged to maintain separate health insurance coverage. If a patient becomes enrolled in Medicare or Medicaid, services must be discontinued. No reimbursement is guaranteed from third parties including, but not limited to HSAs or FSAs.
9. Medications & Prescribing
Controlled substances, including but not limited to: narcotic pain medications and ADHD medications, will not be prescribed via telehealth.
Medications requiring in-person evaluation under Florida law, including but not limited to certain obesity medications (e.g., phentermine), will not be prescribed.
10. Provider Absence
If a provider is unavailable due to vacation, illness, or emergency, patients will be notified when possible. A covering provider may be provided.
11. After-Hours Access
Reasonable efforts may be made to provide after-hours communication for urgent concerns. This does not replace emergency care. OptimaVida Health & Wellness LLC is not liable for delays in care.
12. Financial Responsibility & Membership Agreement
Membership Terms
Monthly memberships:
• Charged monthly from the first appointment.
• Auto-renew until canceled.
• Non-prorated.
• Require a valid card on file.
Prepaid plans (3, 6, 12 months):
• Discounted.
• Non-refundable.
• Do not auto-renew.
Additional fees:
• Services including, but not limited to labs, imaging, medications, are due at time of service.
• Membership may be terminated for non-payment.
• Services may be modified at any time.
13. Late Payments
Payments are considered late if not received within five (5) days after the due date.
• A $25 late fee will apply.
• A re-enrollment fee may apply for reactivation.
• Failure to pay may result in suspension or termination.
Patients are responsible for maintaining valid payment methods.
14. Termination
Either party may terminate this agreement. To cancel a monthly membership, written notice must be provided 30 days in advance.
No refunds are issued once payment has been processed, including but not limited to: Memberships, Labs, Services, and Fees. Prepaid plans do not auto-renew and are non-refundable.
If membership lapses:
• $200 re-enrollment fee applies.
• 5-day grace period may apply.
Immediate termination may occur for: breach of agreement, non-compliance, failure to follow treatment, or missed follow-ups/labs.
If care is terminated, referral resources may be provided. OptimaVida Health & Wellness LLC is not responsible for continuity of care and is not liable for outcomes resulting from termination.
15. Limitation of Liability
To the fullest extent permitted by law, OptimaVida Health & Wellness LLC is not liable for any damages, including but not limited to: medical outcomes, misdiagnosis, delays in care, telehealth limitations, technical failures, patient non-compliance, and third-party services.
